The established HIPAA definition of willful neglect is That which the doctor knew, or should have known, and did not do. Nearly every doctor knows there are things they should do for HIPAA compliance but are not sure what they are or what to do, unfortunately, since you knew or should have known, it automatically puts you in the willful neglect category and those fines, if investigate RANDOMLY or due to a complaint, start at $50,000 and go to $1.5 million.
